1. Who we are
Kemuva, operated by [Seller legal entity], 1309 Coffeen Avenue STE 1200, Sheridan, WY 82801, USA (“Kemuva”, “we”) creates personalized digital keepsakes. Contact: [email protected].
2. Digital products only
All products are digital files delivered by download link. We do not ship physical products. “Print-ready files” are files you can take to a printer of your choice.
3. Ordering and payment
Prices are in USD and shown before payment. Payment is processed by Stripe. Your contract is formed when payment succeeds and we send an order confirmation by email. Each product includes the scope stated on its listing. The Grandparent's life story book ($49) includes up to 60 minutes of audio and a 20–30 page illustrated PDF; longer recordings are quoted before ordering. The Family cookbook includes up to 40 recipes; additional recipes cost $9 per 10 extra recipes, and we will confirm and charge any extra before work starts. The Personalized giant crossword includes up to 20 clues ($19) or up to 40 clues plus a photo ($29).
4. Your material and your rights
You warrant that you own or have permission to use every photo, recording, text and other material you upload, and that people shown or heard (or their guardians) agree to its use for your order. You will not upload unlawful, infringing or explicit content. You grant us a limited licence to use your material only to make and deliver your order. We may refuse orders that breach this section.
5. Delivery, previews and revisions
We aim to send a watermarked preview within 24 hours of receiving all material (life story books: up to 72 hours). Each order includes up to 2 rounds of revisions within the original brief. Once you approve, or 14 days after the preview with no response, we deliver the final clean file.
6. Right of withdrawal (EU/EEA and UK customers)
Under Directive 2011/83/EU (art. 16(m)) and the UK Consumer Contracts Regulations 2013 (reg. 37), you lose your 14-day right of withdrawal for digital content not supplied on a tangible medium once supply has begun with your prior express consent and your acknowledgment that you lose that right. At checkout you give that consent and acknowledgment, and we confirm it in your order confirmation email (durable medium). Products are also personalized to your specifications.
Consent text shown at checkout: “I agree that my order is a digital product made for me; delivery starts immediately and I lose my right of withdrawal once the file is delivered. No refunds after delivery; up to 2 revisions included.”
6a. Voice wave audio
For voice wave art, the audio played by the QR code is stored separately and kept hosted for as long as the QR code is offered, and for a minimum of 5 years. You can request deletion at any time at [email protected]; deletion permanently disables the QR code. All other uploads are deleted 30 days after delivery.
7. AI-generated content
Our pieces are created with the help of artificial-intelligence tools and reviewed by our team. Results are artistic interpretations: likenesses, colors, restored details and generated text (e.g. poems, letters, memoir prose) may not be perfectly accurate. Restorations and colorizations are reconstructions, not historical records. You are responsible for checking names, dates and facts in the preview.
8. Ownership and use of the final file
On full payment you receive a personal, non-commercial licence to use, print and share your file. You may not resell it. We do not use your files in our marketing without your separate written permission.
9. Liability
To the extent permitted by law, our total liability is limited to the amount you paid for the order. Nothing limits rights you have as a consumer that cannot be excluded by law.
10. Governing law
These terms are governed by the laws of the State of Wyoming, USA. If you are a consumer in the EU/EEA or the UK, this does not deprive you of the protection of the mandatory consumer-protection laws of your country of residence, and you may bring proceedings in your local courts.
